WAIVER AND RELEASE OF LIABILITY

I HEREBY agree to the following:
I ACKNOWLEDGE that I am voluntarily participating in yoga or Ayurvedic self-care classes, workshops, courses and/or programs (hereinafter the “Activities”) offered by Julie Gentile LLC (hereinafter also referred to as the “Company”), which may be provided by the Company’s owner, officers, agents, employees, contractors and/or authorized instructors (“Released Parties”). The Activities may be offered at a physical location or online via video, digital media or other platforms. All such offerings, whether in person or online, shall be considered “Activities.”
I FURTHER ACKNOWLEDGE that I must be in adequate physical and mental health to participate in the Activities, which may involve strenuous physical activity and exertion. I represent and warrant that I am physically fit enough to participate and that I do not have any medical, physical or mental health condition(s) that may: (i) limit or prevent my full participation in the Activities; or (ii) be exacerbated in any way by the Activities. I recognize that my participation in the Activities may result in or aggravate a physical injury or medical condition, and I understand it is solely my responsibility to consult with a physician before participating in the Activities. If I have done so, I acknowledge that I have followed the physician’s advice. I understand that Julie Gentile LLC reserves the right to refuse my participation in the Activities at any time on medical, fitness or other grounds.
I FURTHER AGREE that I am voluntarily participating in the Activities provided by Julie Gentile LLC, and I choose to participate in the Activities at my own risk. I acknowledge I am aware of the risks associated with participating in the Activities, including but not limited to high blood pressure, fainting, physical injury, pain, temporary or permanent disability, heart attack, stroke, exposure to bacteria, virus, fungi or a communicable disease, and aggravating pre-existing injuries or medical conditions. I understand my physical limitations, and I am sufficiently self-aware to stop or modify my participation in the Activities before I become injured.
I HEREBY AGREE that in consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly assume full responsibility and liability for any and all risks, injuries or damages, known or unknown, foreseeable or unforeseeable, which I might incur as a result of participating in the Activities. In further consideration of participating in the Activities, I knowingly, voluntarily and expressly waive any and all “Claims” of liability that I may have against Julie Gentile LLC and Released Parties arising out of or related to my participation in the Activities.
I FURTHER AGREE to defend, indemnify and hold harmless Julie Gentile LLC and Released Parties, from and against any and all losses, costs, liabilities, damages, or expenses, in connection with or arising out of any Claim made by me or anyone making a Claim on my behalf, to the fullest extent permitted by law, even if the Claim is alleged to or determined to have resulted from negligence of Released Parties. The terms “Claim” and “Claims” as used in this WAIVER AND RELEASE OF LIABILITY shall be interpreted to include, without limitation, any and all liabilities, demands, damages, settlements, losses, costs, expenses fees (including attorneys’ fees), including claims for personal injury, mental suffering, distress or death, that I may suffer, or that my spouse, children or unborn child(ren) may suffer (including attorneys’ fees) related to my participation in the Activities. Julie Gentile LLC shall not be liable to me, nor to any my heirs, legal representatives, executors, administrators and assigns, for any damages, whether punitive, consequential, special, incidental, direct or indirect damages, Claims in law or equity, that may arise out of my voluntary participation in the Activities.
I FURTHER AGREE that I, binding my heirs, legal representatives, executors, administrators and assigns, hereby forever release, waive and discharge, and covenant not to bring a legal action against Julie Gentile LLC and Released Parties from any and all Claims, demands or causes of action, related to my participation in the Activities, regardless of cause, including but not limited to Claims arising from the negligent or other acts or omissions of any Released Party. I further agree that this Release shall be governed by and construed in accordance with the laws of the State of Illinois without regard to conflict-of-law principles. This WAIVER AND RELEASE OF LIABILITY shall remain in effect for the duration of my participation in the Activities, including this and all future sessions of participation.
I FURTHER ACKNOWLEDGE that I have carefully read this WAIVER AND RELEASE OF LIABILITY, and I fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein. I am aware that by signing this WAIVER AND RELEASE OF LIABILITY, I am voluntarily giving up or waiving any rights that I have to bring any legal action against Julie Gentile LLC or Released Parties, and that this waiver binds my heirs, legal representatives, executors, administrators and assigns, and I agree to indemnify Julie Gentile LLC from anyone who attempts to bring such a Claim on my behalf.
If a court of appropriate jurisdiction determines that any provision of this WAIVER AND RELEASE OF LIABILITY is invalid or unenforceable, this shall affect only that provision and will not make any other provision of this WAIVER AND RELEASE OF LIABILITY invalid or unenforceable. The affected provision shall be modified, amended or limited only to the extent necessary to render it valid and enforceable.
